1. About this policy

This Privacy Policy explains how the Responsive Group (“we”, “us”, “our”) collects, uses, holds, discloses and protects your personal information. We are committed to protecting your privacy and complying with the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs), and — as a credit licensee — Part IIIA of the Privacy Act and the Privacy (Credit Reporting) Code where they apply.

2. Who we are

The Responsive Group is made up of the following related companies and referral partners:

•      Dasso Investments Pty Ltd trading as Responsive Lending (ABN 72 157 765 047, Australian Credit Licence 470 980)

•      Responsive Lending Mortgages Pty Ltd

•      Responsive Debt Repair

•      Bonvoyage Debt Repair

From time to time we may also work with additional referral partners and third parties that we bring into the Responsive Group Community to help you access assistance and deals. A current list of our referral partners is available on request.

3. The kinds of information we collect

Depending on how you interact with us, we may collect:

•      Contact and identity information — name, email, phone, postcode/state, and (if you apply for a product) date of birth and identification;

•      Community and enquiry information — the products or help you're interested in, your borrowing timeframe, home ownership status, messages you send us, and how you heard about us;

•      Consent records — what you agreed to and when;

•      Financial and credit information — where you proceed with a credit or debt-assistance service, we may collect income, expenses, assets, liabilities, and credit-related information (see section 4);

•      Technical information — where you use our website or forms, information such as your IP address and device/browser details.

At community sign-up we only collect what we reasonably need (name, contact details, location and your interests). We do not collect financial details or ID at that stage.

4. Credit information

As a credit licensee, if you apply for or enquire about credit, or use a debt-assistance service, we may collect and handle credit information and credit eligibility information under Part IIIA of the Privacy Act. This can include information from credit reporting bodies and credit providers. We use this information to assess and arrange credit and to meet our responsible-lending and other legal obligations. Our separate Credit Guide and credit-specific privacy disclosures will be provided to you at that time and set out additional detail, including the credit reporting bodies we deal with and your rights.

5. How we collect your information

We collect information directly from you (through our forms, community, phone, email or in person), and where relevant from third parties such as credit reporting bodies, lenders, your referees, and referral partners, where you have consented or the law permits.

6. Why we collect, use and hold your information

We use your personal information to:

•      Provide our community, respond to enquiries and give obligation-free quotes;

•      Assess, arrange and manage finance, mortgage and debt-assistance services;

•      Administer memberships, benefits, discounts and prize draws;

•      Send marketing communications where you have consented (see section 8);

•      Meet our legal, regulatory, record-keeping and risk-management obligations.

7. Who we disclose your information to

We may disclose your personal information to:

•      Our related Responsive Group companies and referral partners (see section 2), so the right team or partner can help you;

•      Lenders, credit providers, aggregators, insurers and product providers, where you ask us to obtain a quote or arrange a product;

•      Credit reporting bodies and other credit providers, in connection with credit applications;

•      Our service providers (for example form, CRM, email/SMS, cloud storage and IT providers); and

•      Regulators, courts or others where required or authorised by law.

We do not sell your personal information. Where we disclose information to a referral partner or third party for their own marketing, we do so only with your consent.

8. Direct marketing and your choices

We will only send you marketing by email, SMS or telephone if you have consented, and you can opt out at any time — use the unsubscribe link in any email, reply STOP to any SMS, or contact us. We comply with the Spam Act 2003 and the Do Not Call Register requirements. Opting out of marketing will not affect our provision of any service you have requested.

9. Storage, security and data location

We take reasonable steps to protect your personal information from misuse, interference, loss, and unauthorised access, modification or disclosure. Information collected through our online forms is stored on Zoho's Australian data centres (within Australia). Some of our other service providers may store or process data outside Australia; where that occurs, we take reasonable steps to ensure your information is handled consistently with the APPs.

10. Accessing and correcting your information

You may request access to, or correction of, the personal information we hold about you at any time by contacting us using the details below. We will respond within a reasonable time and may need to verify your identity. In limited circumstances we may decline access as permitted by law and will explain why.

11. Complaints

If you have a privacy concern or complaint, please contact us first (details below) and we will investigate and respond within a reasonable time. If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au or 1300 363 992. For complaints relating to credit or our credit services, you can also contact the Australian Financial Complaints Authority (AFCA) at afca.org.au
